Terms of use
This English version is a courtesy translation. The Spanish version is the only legally binding one and prevails in case of any difference: read the Spanish version.
1. Who we are
Prisma ("the Service", prisma.jorgeavila.com) is provided by Jorge Avila Meléndez, an individual with an address at Av. Insurgentes 4001 Interior 615, col. Colinas de San Jerónimo, Monterrey, Nuevo León, México, C.P. 64630 ("we"). By creating an account or using the Service you accept these Terms and the Privacy notice.
2. The Service
Prisma organizes public YouTube videos by topic and priority. You choose the creators of each feed, and Prisma builds a queue with the most important and recent, and remembers what you've already watched. You can also publish feeds, follow other people's, rate them and share Ideas.
Prisma is free and shows no ads. It is not part of YouTube or Google, nor affiliated with them. It doesn't host or download videos: they play in YouTube's official player and remain subject to the YouTube Terms of Service.
3. Your account
- You must be of legal age or use Prisma with the permission of your mother, father or guardian, and provide truthful information.
- Each person uses their own account. You are responsible for keeping your password safe and for what happens with your account.
- Use "Keep me signed in" only on your own devices. If you think someone got into your account, change your password and sign out of all your devices from your profile.
4. What you publish
You are responsible for what you publish: public feeds, Ideas, updates and replies. What you publish remains yours; while it is public, you allow us to display it on Prisma free of charge and on a non-exclusive basis.
Don't publish illegal, offensive, discriminatory or misleading content, spam, other people's personal data or anything that infringes third-party rights. Don't impersonate anyone.
5. Ideas are not investment advice
Ideas and their replies are the personal opinions of whoever publishes them, not investment recommendations. Prisma does not review or verify what is published and does not provide financial advisory services. Make your decisions with your own judgment and, if you need it, with professional advice.
If you have an interest in what you comment on (for example, you hold that investment or you're paid to talk about it), say so in your Idea. Don't use Prisma to try to move prices or to promote fraudulent schemes.
6. Moderation
- The owner of a feed can hide replies within their feed.
- Anyone with an account can report an Idea or a reply.
- The administration may hide content that breaches these Terms and suspend the accounts that breach them.
We don't review content before it is published, but we act on reports.
7. Acceptable use
You may not use Prisma for unlawful activities, to try to access other people's accounts or data, breach its security, scrape its content automatically, reverse engineer it, overload it on purpose, or to get around YouTube's rules. We may suspend accounts that break these rules.
8. Availability and changes
We aim to keep Prisma available at all times, but there may be interruptions for maintenance or for reasons beyond our control. Prisma depends on YouTube: if a creator deletes a video or YouTube changes its services, that content may stop appearing. We may improve, change or remove features.
9. Intellectual property
The Prisma brand, its design and its code belong to Jorge Avila Meléndez. The videos, their titles and their thumbnails belong to their creators. We grant you a limited, non-exclusive and non-transferable right to use Prisma while your account is active.
10. Warranties and liability
Prisma is free and provided "as is". To the extent permitted by law, we don't guarantee results and are not liable for third-party content (videos, feeds, Ideas or replies from other people), for decisions you make based on them, or for indirect damages or lost profits.
11. Suspension and termination
You can stop using Prisma whenever you want and ask us to close your account, as explained in the Privacy notice. We may suspend or close accounts that breach these Terms.
12. Changes to these Terms
If these Terms change, we'll let you know in Prisma. We keep a record of which version you accepted, when and from which connection.
13. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Monterrey, Nuevo León, waiving any other jurisdiction, without prejudice to the non-waivable rights the law grants to consumers. The Spanish version prevails over any translation.
